Seller Identification
This website www.takoon.com (the "Website") is published by the company Takoon, a Simplified Joint Stock Company with a capital of 1,003,307.00 euros, registered with the RCS of Lorient under the number 451 532223344, VAT number: FR89532223344, hereinafter referred to as "TAKOON".
Preamble
These general terms and conditions of sale (the "General Conditions") are concluded between Takoon and any non-commercial individual ("You") wishing to make a purchase on the Website.
These General Conditions exclusively govern your relationship with Takoon.
Takoon reserves the right to modify the General Conditions at any time. They will be applicable upon their posting.
The Customer's order implies acceptance of all of these general terms and conditions of sale.
The Products
The products governed by these General Conditions are those displayed on the Website and indicated as sold and shipped by Takoon (the "Products"). They are offered within the limits of available stocks.
The products offered for sale on the website www.takoon.com are offered within the limits of available stocks. In case of stock shortage after placing the order or impossibility to deliver the product, Takoon will inform the User as soon as possible by email. The User can then cancel the order and be refunded the price of the product within fourteen (14) days following the cancellation of the order. However, these provisions do not deprive the User of exercising his right of withdrawal. Takoon informs the User of all the essential characteristics of the goods offered. These characteristics appear alongside the photograph illustrating the offer. Takoon invites the User to carefully read these characteristics.
The User acknowledges that the photograph representing the product on the website has only indicative value. Alterations may indeed appear due to the processing of the photograph.
The essential characteristics of the Products are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred in this presentation, Takoon's liability could not be engaged, if in accordance with Article L221-15 of the Consumer Code created by Ordinance No. 2016-301 of March 14, 2016: "all or part of its liability by providing evidence that the non-performance or improper performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure".
The photographs illustrating the products in support of the text do not enter into the contractual scope.
PRICE
The prices of the products offered for sale are expressed as follows excluding delivery costs:
European Union: in euros all taxes included (VAT) United Kingdom: in British pounds all taxes included (VAT) Rest of the World: in US dollars excluding taxes (VAT) Delivery costs remain the responsibility of the User and are indicated to him before validating his order.
Tax Refund:
According to current tax law, tax refund applies to travelers with habitual residence in a non-European Union state or in a third country (excluding overseas departments, Monaco). From €175 including VAT excluding shipping costs, we can deliver to France and provide you with a tax refund form to be validated by French customs upon leaving the territory. Once this form is stamped by customs within 3 months from the date of purchase, we will proceed to refund the VAT.
To benefit from this tax refund, once your order is validated, you need to send us by email to sales@takoon.com a copy of your passport, a registration card from your consulate, or any other document proving your residence abroad.
We will then proceed with the refund within a maximum of 30 days, either by bank transfer (please provide bank details) or by crediting the credit card used for the purchase.
Takoon reserves the right to modify its prices at any time. However, products will be invoiced based on the rates in effect at the time of ordering.
Validity of Offers
The items visible on the site are available until stocks are exhausted.
In case of debit or cashing out for the order of an unavailable item, Takoon undertakes to offer a credit note or to refund the Customer within fourteen (14) days, in accordance with Article L221-23 of the Consumer Code.
Takoon undertakes to notify by email the Customer who has placed an order for an unavailable item. In case of unavailability, we will offer: either a new delivery time, or a replacement product. In case of refusal of both proposals, your order will be immediately canceled and refunded if your bank account had been debited.
We indicate on the site different levels of availability for the products put online.
Product Prices
Prices are presented in euros all taxes included for Metropolitan France.
The amount of VAT is indicated when selecting a product by the Customer. If the VAT rate were to be changed, these changes could be reflected in the price of the items without prior notice to the customer.
Takoon reserves the right to modify its prices at any time but products are invoiced at the price in effect at the time of order registration.
The price of products for overseas departments and territories, for Switzerland, as well as for countries not belonging to the European Union is indicated excluding taxes.
Any order placed on the Site and delivered to Switzerland or overseas departments and territories, or any other country not belonging to the European Union may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the responsibility of the customer and are your responsibility. We are not obliged to check and inform you of applicable customs duties and taxes. Please note that by ordering on the Site, you are considered the official importer and are required to comply with all laws and regulations of the country where you will receive the goods. We want our customers to be aware that cross-border deliveries may be subject to customs inspection.
Order and Secure Payment
Once your cart is validated, you will need to choose the address, delivery method, and validate your payment method, this last step formalizing the sales contract with Takoon.
Any order implies acceptance of the prices and descriptions of the Products available for sale.
Takoon will acknowledge receipt of your order upon validation by sending you an email containing, among other things, a link to these General Conditions of Sale.

By bank transfer:
Upon registration of your order, we reserve the chosen equipment for you and confirm the receipt of your order by email. The reservation of the equipment is valid for 7 days (date of order), a period allowing you to proceed with the transfer. Once our bank confirms your transfer, we will contact you to inform you of the billing and delivery of your order.
Please note, the payment method by bank transfer may be imposed when the delivery address is in certain countries, particularly outside the European Union.

In any case, Takoon reserves the right to refuse any order or delivery in case of: existing dispute with the User, total or partial non-payment of a previous order by the User, refusal of payment authorization by credit card issuers.
The customer validates his order as follows. This validation implies acceptance of these general terms and conditions of sale.
The customer interested in an item visible on the website www.takoon.com follows the following process to establish his order. After clicking on the "confirm" icon and after checking the specifics of his order (color, quantity, size, price, etc...), the customer validates the choice of the selected product(s) with a click.
If the customer benefits from a special offer, he must first enter a code assigned to him in the field provided for this purpose. During his first order, the customer has a form to fill in containing the following information: title, last name, first name, complete delivery address, email, date of birth, phone number. On this occasion, the customer creates his password.
After validating his payment method, the customer definitively and irrevocably validates his order with the following effects indicated.
Default of Payment
Takoon reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is ongoing.
Payment Verification
Takoon checks all orders that have been validated on its website. These checks aim to protect Takoon from abusive practices carried out by fraudsters.
Our services may ask you for all the necessary documents to unblock your order: proof of residence or debit in your name, or proof of residence in the name of the person indicated for the delivery address, etc. These requests will be made by email:

To ensure payment security, the Takoon website uses the secure payment service Lyra. This service integrates the SSL security standard. Confidential data (the 16-digit bank card number as well as the expiration date, the CVX code) is directly transmitted encrypted to the bank's server without passing through the physical media of the Takoon server.
Delivery
The products are delivered to the delivery address you provided us during the ordering process. All shipments are insured for the actual value of the goods.
Problem? Your package arrives damaged or late?
Please carefully examine the condition of your package and merchandise upon receipt in the presence of the delivery person. Refuse the package if it appears to have been damaged, otherwise, we will not be able to replace your merchandise. Please note, in case of a problem, keep the original packaging.
Shipping times: Any item ordered is shipped within 48 hours. All announced deadlines are calculated in working days. These are average deadlines that correspond to the processing, preparation, and shipping time of your order (warehouse dispatch). To this deadline, the carrier's delivery time must be added.
Delivery times: The ordered product is delivered by postal service or an independent carrier, depending on the nature of the product ordered and at the exclusive initiative of TAKOON, to the address indicated on the order form. The announced deadlines are indicated from our warehouse for indicative purposes only.
We decline all responsibility in case of delays due to strikes, natural disasters, etc.
Receipt of Merchandise:
The User is required to check the condition and contents of the package received and to verify that it conforms to their order. If the package is damaged or shows signs of tampering, the User must issue written reservations on the delivery slip accompanied by their signature. This verification is considered to have been carried out as soon as the buyer, or a person authorized by them, signs the delivery note. You must report any anomalies by registered mail and confirm your reservations with the carrier no later than 3 working days following the receipt of the item(s) and send a letter to support@takoon.com
If no reservations have been made upon delivery of the package or upon receipt of the package by the User, TAKOON will not be able to provide compensation or cancel the order. It is reminded that the right of withdrawal only allows the return of a new, unused, and undamaged product.
Returns for "NPAI" (Address Not Found) Reasons:
These are packages returned by the carrier with the mention: "N’habite Pas à l’Adresse Indiquée" (Does Not Live at the Specified Address).
Upon receipt and acceptance of your package by our services, Takoon will contact the customer to either resend the order if the product is still available or proceed with the refund of the order according to the customer's preference. In this case, the outbound shipping costs will remain the responsibility of the customer.
Takoon reserves the right to proceed with the refund of the order rather than resending it in case of multiple "NPAI" instances being identified.
Returns for "NON RECLAME" (Not Claimed) Reasons:
These are packages that have not been claimed by the customer at the Post Office, from an independent carrier, or at the Relay Point within the specified time limits.
Upon receipt and acceptance of your package by our services, Takoon will contact the customer to either resend the order if the product is still available or proceed with the refund of the order according to the customer's preference. In this case, the outbound shipping costs will remain the responsibility of the customer.
Takoon reserves the right to proceed with the refund of the order rather than resending it in case of multiple "NON RECLAME" instances being identified.
Returns for "REFUSE" Reasons:
You refused your package at the time of delivery.
Upon receipt and acceptance of your package by our services, a store credit will be credited to your customer account within 72 hours of receiving your package.
In the event of a package being returned due to "NPAI", "NON RECLAME", or "REFUSE" reasons, Takoon does not guarantee the reservation of the ordered items and may proceed with the refund of the order if the product(s) are not available.
Right of Withdrawal, Return of Product
Right of Withdrawal (only for deliveries in France and Europe):
All Products delivered in Europe may be subject to a refund except those excluded by law and bearing a mention to this effect, for example, Products that have been personalized at the User's request, computer software, audio or video recording Products when the protective blister has been removed, etc.
The Products must be intact, complete, and packaged in the original packaging.
The User has a withdrawal period of fourteen (14) calendar days from the date of receipt or collection of the Products.
To exercise your right of withdrawal, You can use the standard withdrawal form to be completed here, or make any unambiguous statement indicating your intention to return the Product to Takoon, in particular by declaring your return online or by notifying us by email at support@takoon.com
Takoon will acknowledge receipt of your withdrawal by email.
